This week’s newsletter covers various Circulars/notifications issued by certain regulatory authorities such as the Ministry of Corporate Affairs (“MCA:), Securities and Exchange Board of India (“SEBI”) and orders passed by the SEBI and Supreme Court.

The Regulatory authorities provided various updates/relaxations, some of which being:

  1. MCA vide notification dated August 18, 2022 issued the Companies (Incorporation) Third Amendment Rules, 2022.
  2. SEBI vide circular dated August 17, 2022 details out the guidelines for overseas investments by Alternative Investment Funds (AIFs)/ Venture Capital Funds (VCFs).

  1. In the matter of Titan Company Limited, the SEBI imposed penalty of INR.1,00,000/ on Noticee for violation of provisions of PIT regulations

SUPREME COURT

  1. Section 12A of the Commercial Courts Act, 2015 was considered mandatory by the Supreme Court in case of question whether the Statutory pre-litigation mediation be contemplated
